In spite of the time granted by this Court no instruction has been received by the respondents.
The contention of the petitioner is that he is owner of Plot No. 581, area 10 biswas, situated at Village Kakadev, Pargana and Tehsil Kanpur Nagar. The said property is said to be his ancestral property and the name of his grandfather – Jairam Singh is recorded in revenue papers. A copy of the revenue record to demonstrate the said fact has been filed by the petitioner.
It is stated that in the year 1957 the respondents have acquired various lands for the purposes of industrial development and an award was also passed on 1.6.1957. In the said proceedings Plot No. 581 was excluded from the acquisition but later on the said land has been used for construction of road. It is further stated that no compensation has been paid, to which the petitioner has made repeated representations to the respondent authorities, however, they have failed to elicit any response.
Earlier, the Court has granted time to the respondents to seek instructions, but no instruction is on the record.
In view of the above, we are of the opinion that ends of justice would be subserved by issuing a direction upon the fourth respondent to consider the cause of the petitioner and pass appropriate order in accordance with law expeditiously, preferably within four months. The petitioner is permitted to file a copy of representation along with a certified copy of this order within ten days from the date of receipt of this order.
The writ petition is, accordingly, disposed of. No order as to costs.
