Heard learned counsel for the petitioners and learned Standing Counsel for the State.
By means of this contempt application filed under Section 12 of the Contempt of Courts Act, 1971 non compliance of the order dated 19th August, 2019 passed in Public Interest Litigation (PIL) No.1495 of 2019 is complained of.
From perusal of the order, it transpires that there was no direction to draw appropriate proceedings for removal of encroachment over public utility land.
Learned Standing Counsel has filed compliance affidavit annexing therewith a copy of order passed by Tehsildar, Sadar, district Mau dated 14.9.2021 whereby the proceedings drawn under Section 67 of the U.P. Land Revenue Act, 2006 have been brought to their logical end.
Now, it is for the authority concerned to ensure that the order under Section 67 of the of the U.P. Land Revenue Act, 2006 of the Court is duly executed provided there is no impediment.
Accordingly, notices are discharged and the contempt application is consigned to records.
