JUDGMENT / ORDER

Heard Sri Mahendra Pratap Singh, learned counsel for the petitioners and the learned Standing Counsel for the State-respondents.
By means of this writ petition, the petitioners have prayed for the following relief:-
"(i) issue a writ, order or direction in the nature of mandamus commanding the opposite parties to consider and decide the representation of the petitioners dated 11.12.2019 contained as Annexure No.3 to the writ petition in view of the law laid down by the Hon'ble Supreme Court in the judgment and order dated 02.09.2019 passed in Civil Appeal No.6798 of 2019; Prem Singh vs. State of U.P. and others seeking to count services of the petitioners rendered on daily wage basis under the respondents, in the regular services of the petitioners for the purposes of pension, gratuity and others service benefits."
It has been submitted by learned counsel for the petitioners that for redressal of their grievances, the petitioners have preferred representation to the Competent Authority, but no decision has been taken on the same till date, therefore, the petitioners have been suffering irreparable loss and injury.
Learned counsel for the petitioners has submitted that the petitioners may be permitted to prefer afresh representation to the Additional Chief Secretary, Public Works Department, Government of U.P., Civil Secretariat, Lucknow and the direction may be issued to him to consider and decide the said representation of the petitioners with expedition.
Learned counsel for the opposite parties has no objection if direction for disposal of the said representation is issued.
In view of the above, without entering into merits of the issue, the petitioners are permitted to prefer a fresh representation to the Additional Chief Secretary, Public Works Department, Government of U.P., Civil Secretariat, Lucknow raising all their pleas and grounds which are available with them annexing therewith copy of their earlier representation and the relevant documents in support of their claim within fifteen days from today, and if any such representation is preferred by the petitioners within a stipulated time, the authority concerned shall consider and decide the representation of the petitioners, strictly in accordance with law by a speaking and reasoned order, with expedition say within a period of three months from the date of presentation of a certified copy of this order along with representation and the decision thereof be intimated to the petitioners forthwith.
In view of the aforesaid terms, the writ petition is disposed of finally.
