The petitioner was a permanent employee of Mihir Textile Mill Ltd. (respondent herein). His services were terminated. The Labour court refused to grant relief of reinstatement to the workman on one of the grounds that the company was already closed.
2. Mr. N.S. Sheth, learned Advocate for the petitioner states that respondent, Mihir Textile Mill Ltd. has now been taken over by Mafatlal Gagalbhai Textile Ltd., having its registered office at 5th Floor, Mafatlal Centre, Nariman Point, Vidhya Bhavan Road, Mumbai- 400021 and further submits that the petitioner has right to sue and right to relief against the said Mafatlal Textile Ltd.
3. In the petition, the endorsement of service of rule indicates that Rule has returned unserved.
4. The Registry to issue a fresh notice to the respondent returnable after four weeks.
5.. The petitioner shall serve the notice by Speed Post in addition to normal mode of service.
