Learned counsel for the applicant submits that, in Criminal Misc. Application No.11834 of 2011 filed by the applicant herein with regard to other cheque, the Coordinate Bench of this Court [Coram: J.C. Upadhyaya, J.], by order dated 16.12.2011, issued notice and protected the applicant by granting ad-interim relief in terms of paragraph 13[C] in the said application.
Considering the above aspect and the subject matter being at par with Criminal Misc. Application No.11834 of 2011, issue notice returnable on 3.4.2012.
Ad-interim relief in terms of paragraph 13[C] Learned APP waives service on behalf of the State.
Direct service is permitted qua the private respondent.
