Heard learned Senior Counsel Mr.N.D.Nanavati for Nanavati Advocates for the applicant, Mr.Girish Das, learned advocate for the respondent no.2 and Mr.K.P.Raval, learned Additional Public Prosecutor for the respondent no.1-State and perused the relevant papers and more particularly, considered the order dated 16.12.2011.
Considering the facts and circumstances of the case, it appears that arguable questions are involved in this matter, and therefore, RULE returnable on 16th April,2012.
Interim relief in terms of Para-13(C) granted vide order dated 16.12.2011, shall continue.
Mr.Girish Das, learned advocate for the respondent no.2 waives service of RULE for the respondent no.2 and Mr.K.P.Raval, learned Additional Public Prosecutor for the respondent no.1-State waives service of RULE for the respondent no.1.
