JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) Rule.
Ms.C.M.Shah, learned APP waives service of rule on behalf of the respondent-State.
By way of the present application, the applicant-convict has prayed that he be enlarged on temporary bail since he wants to take care of his daughter who is to appear in the board examination of Standard-12 in March of this year.
The ground, according to us, is not such where the presence of the applicant-convict can be said as indispensable coupled with the fact that the applicant has already availed furlough leave in October, 2011.
Under these circumstances, the discretion does not deserve to be exercised. Hence, the application is rejected. Rule discharged.
