Learned A.G.A. has filed counter affidavit which is taken on record.
Heard learned counsel for the applicant and the learned A.G.A. for the State and perused the record.
This bail application has been filed on behalf of the applicant involved under Sections 302, 34 of I.P.C., Police Station Kurawli, District Mainpuri arising out of case crime No. 427 of 2017.
As per the prosecution case, daughter of the informant while going along with her mother to answer nature's call was ambushed by the applicant and two other accused persons; they forcefully took away the daughter of the informant at gun point; thereafter, her body was found hanging from the tree; postmortem examination report supports the prosecution case; cause of death is due to hanging, ligature mark around the neck; her mother is the sole witness about the incident; she has supported the prosecution version in her statement under Section 161 Cr.P.C.
Learned A.G.A. has opposed the prayer for bail submitting that it is not in public interest to enlarge the applicant on bail at this stage.
Considering the facts and circumstances of the case, I am not inclined to allow the bail application.
The bail application is, accordingly, rejected.
The trial Court is directed to expedite the trial and conclude the same expeditiously on day to day basis from the date of production of a certified copy of this order provided there is no other impediment.
Office is directed to send a certified copy of this order to the trial Court concerned for immediate compliance.
