1. RULE.
Mr. Rajesh Chauhan, learned advocate for Mr. H.S. Munshaw waives service of Rule on behalf of the opponent - original petitioner. The applicant- original respondent has prayed for the following reliefs:-
"a) This Hon'ble Court be pleased to direct the opponent herein to release the regular increments from the date of reinstatement of the applicant and be further pleased to direct the opponent to pay all the arrears and pending amount thereof to the applicant forthwith.
b) This Hon'ble Court be pleased to fix the main matter being SCA No.8182/2005 with SCA No.14724/2005 for the final hearing at an early date as may be convenient to this Hon'ble Court.
c) Such other and further relief as this Hon'ble Court may deem just, fit and expedient be granted to the applicant.
d) Costs of this application be provided for to the applicant."
2. Heard Mr. Chinmay M. Gandhi, learned advocate for the applicant - original respondent and Mr. Rajesh Chauhan, learned advocate for Mr. H.S. Munshaw for the opponent - original petitioner.
3. Considering the averments made in the application, the prayers prayed for in Para 6(a) cannot be granted at this stage. However, it will be open for the applicant to urge the said issue at the time of final hearing of the main writ petitions. However, considering the facts and circumstances as well as the averments made in the application, the prayers prayed for in Para 6(b) is granted. The main matters being Special Civil Application No.8182 of 2005 with Special Civil Application No.14274 of 2005 is fixed for hearing in the week beginning from 18.6.2012.
4. With these observations, the application is partly allowed. Rule is made absolute only to the aforesaid extent with no order as to costs.
