By order dated 13.2.2018 in Public Interest Litigation (PIL) No. 2887 of 2018 filed by the applicant, this Court directed Tehsildar, Tehsil Sadar, district Ballia to enquire into the allegation that name of certain private persons (respondent Nos. 5 & 6 to the writ proceedings) was wrongly entered over Arazi No. 206, which according to the applicant is a pond. There was further direction to the Tehsildar to take appropriate action in accordance with law within a period of two months from the date of receipt of certified copy of the order.
Sri P.K.Giri, learned Additional Chief Standing Counsel, on instructions from opposite party, states that in compliance of order of the writ Court, the opposite party held an enquiry and found that name of certain persons was wrongly recorded over Gata No. 206, and accordingly their names have been expunged and the said plot has now been recorded as a pond. The instructions furnished to learned Additional Chief Standing Counsel further states that after correcting the revenue entry, proceedings under Section 67 of the U.P. Revenue Code, 2006 had been initiated against unauthorised occupants and in which next date fixed is 24.8.2018.
Having regard to the aforesaid stand of the opposite party, this Court is of the opinion that substantial compliance of the direction issued by the writ Court has already been made. In such view of the matter, this Court is not inclined to proceed any further in the instant matter.
The contempt application is consigned to record.
