Heard Mr. Pankaj Kumar Ojha, learned learned counsel for the petitioner, Mr. Sudhanshu Srivastava, learned Additional Chief Standing Counsel for respondents 1 and 2, Mr. Neeraj Tripathi, learned counsel for respondent No. 3 and Mr. Surya Bhan Singh, learned counsel holding for Mr. Shiv Nath Singh, learned counsel for respondent Nos. 4, 5, 6 and 7.
The principal prayer made in the writ petition reads thus:
"(I) issue a writ order of direction in the nature of mandamus directing respondent authorities to take necessary action against the responsible persons for misappropriation of the public fund of Chandra Shekhar Ajad University, Kanpur on the basis of Audit Report dated 30/11/2017, 06/01/2018 and 06/01/2018 conducted by Auditor General Allahabad."
Counsel for respondent No. 4, on instructions, submits that respondent No. 4 shall initiate proceedings/action on the basis of the Audit Report No.78 (2015-16), as stated in the letter dated 6.1.2018 (Annexure 7), against the erring persons at the earliest and shall take to its logical end within six months from the date of receipt of this order. His statement is recorded and accepted. In view thereof, counsel appearing for the petitioner does not press this writ petition. Petition is disposed of. Petitioner is directed to communicate this order to the fourth respondent alongwith a copy of the writ petition and annexures within two weeks from today.
