Mahesh Kumar And Another vs Civil Judge

High Court Of Judicature at Allahabad|31 October, 2018
|

JUDGMENT / ORDER

Court No. - 33
Case :- MATTERS UNDER ARTICLE 227 No. - 7951 of 2018 Petitioner :- Mahesh Kumar And Another Respondent :- Civil Judge (Junior Division) City, Jaunpur And Another Counsel for Petitioner :- Kailash Nath Singh Hon'ble Manoj Misra,J.
The instant petition has been filed for a direction upon the court concerned to decide application 6-C in Original Suit No.1032 of 2017 within a stipulated period.
The contention of the learned counsel for the petitioners is that by order dated 06.05.2018 the service of notice on the other side was held sufficient through publication and a date was fixed for consideration of application 6-C but on the next date, on account of lawyers' strike, another date was fixed and the date so fixed does not disclose that the application 6-C has been put up for orders.
Be that as it may, the petitioners can apply to the court concerned on the next date for consideration of the application 6-C if the same is pending and other side has been served with notice of the proceedings.
With the aforesaid liberty, the petition is disposed off.
Order Date :- 31.10.2018 AKShukla/-
