The petitioners seek direction upon the respondents to issue mark-sheet of TET-2011 (Primary Level) to them.
Learned standing counsel submits that a criminal case no. 675 of 2011 under section 420/120 B and 7/13 of Prevention of Corruption Act, 1988, police station Akbarpur, district Kanpur Dehat has been registered in respect of irregularities in said TET-2011 Examination against the person responsible for irregularities. In compliance of the order of this Court, investigation is going on by the police and the entire documents have been sealed. It is further stated that the said criminal case is pending in the Special Sessions Trial Court, Kanpur Dehat. It is contended that the counselling for appointment of Assistant Teachers is commencing from 22.9.2014 and in case duplicate statement of marks of TET-2011 is not issued to the petitioners, they will suffer irreversible loss.
Counsel for the petitioners has also invited the attention of this Court to the order passed by this Court of Lucknow Bench, Lucknow in Misc. Single No. 5779 of 2014; Anjali Pandey Vs. State of UP, wherein the petitioner in the said case has been permitted to participate in the counselling on the basis of certificate generated from internet.
Accordingly, the respondents are directed to permit the petitioners to participate in the counselling on the basis of statement of marks down loaded from the website of Madhdyamik Shiksha Parishad, Allahabad. In the event, the petitioners submit the duly attested statement of the marks which they have downloaded shall be considered provisionally and their result shall abide order of this Court.
Learned standing counsel may file counter affidavit within six weeks. Rejoinder affidavit, if any, may be filed within a week thereafter.
List after expiry of the aforesaid period.
