This application under Section 482 Cr.P.C. has been filed seeking a direction to decide the application dated 15.9.2016 filed in Case No. 3878 of 2010 (State Vs. Mahesh Kumar Gupta), under Section 7/16 Prevention of Food Adulteration Act, Police Station Phase -II Noida District Gautam Budh Nagar pending in the court of Additional Chief Judicial Magistrate, Gautam Budh Nagar.
It is submitted by the learned counsel for the applicant that he has filed an application dated 15.9.2016 for release of the seized case property before the trial court but the same has not been disposed of till date.
The copy of the application dated 15.9.2016 has been filed as Annexure No.4 and the certified copy of the objection dated 14.12.2017 of the opposite party no.2 has been filed as Annexure no.3 to the application.
I have perused the record.
Considering the facts and circumstances of the case on record, I direct the Additional Chief Judicial Magistrate, Gautam Budh Nagar to decide the case no. 3878 of 2010 (State Vs. Mahesh Kumar Gupta) under Section 7/16 Prevention of Food Adulteration Act within a period of six months from the date of production of certified copy of this order without granting unnecessary adjournment to the parties concerned.
With these observation, this application is disposed of.
