JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) MONDAY, THE THIRTEENTH DAY OF OCTOBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.29022 of 2014 BETWEEN Mahesh Kumar Agarwal AND ... PETITIONER The State of Telangana, Rep. by its Principal Secretary (Department of Revenue), A.P. Secretariat Building, Hyderabad and others.
...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. Petitioner states that he made a complaint, Ex.P1, before the Inspector of Police, Charminar Police Station, on 26.06.2014 alleging that there was a fire accident at his shop at the 2nd floor, R.J.Market, Hyderabad. In the said complaint, it was stated that the accident took place on 23.06.2014.
However, petitioner being disturbed did not make any such complaint earlier. The present writ petition is filed stating that the petitioner was pursuing the matter with the fire department and however, the police viz., respondent No.3, in particular, has not taken any action in registering the F.I.R. and has not taken any further action thereon.
3. Learned Government Pleader, on instructions, states that the fire accident allegedly took place on 23.06.2014 and the fire department sent fire engine and quickly controlled the fire. It is stated that though the petitioner submits that there was considerable loss suffered by him, no complaint, as such, was received by the police so far and only an Advocate appears to have called the Station House Officer by telephone.
4. Evidently, no complaint of the petitioner was received by the Station House Officer and the copy of the complaint filed by the petitioner along with the writ petition does not contain any acknowledgment.
5. In the circumstances, the writ petition is disposed of permitting the petitioner to file an appropriate complaint by approaching respondent No.3 personally or by registered post with acknowledgment due and, if such a complaint is received, respondent No.3 shall take appropriate action thereon expeditiously in accordance with law.
As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
VILAS V. AFZULPURKAR, J October 13, 2014 Note:
Furnish C.C. of the order by 17.10.2014.
