The petitioner/party-in-person seeks for transfer of C.C.No.444 of 2011 on the file of the XVI Special Magistrate, Hyderabad to the Court of the V Special Magistrate, Hyderabad, where a connected case in C.C.No.75 of 2011 is said to be pending.
2. Notice was ordered to the 1st respondent. In the charge-sheets in C.C.No.444 of 2011 as well as in C.C.No.75 of 2011, the address of the 1st respondent herein was furnished. The party-in-person has taken notice to the said address. The postal cover was returned with endorsement that the notice was not claimed.
I therefore consider it appropriate to dispose of this petition on merits as the party-in-person has taken steps for issuing notice to the other side.
3. The party-in-person submitted that C.C.No.444 of 2011 and C.C.No.75 of 2011 are connected inter se as the accused as well as the de facto complainant are one and the same and that the nature of the offences is also more or less identical.
4. In view of the administrative convenience, it would appear that one case was made over to the Court of the XVI Special Magistrate, Hyderabad whereas the other case was made over to the V Special Magistrate, Hyderabad. I consider it appropriate to direct that both cases be before the same Court for convenient disposal.
5. Accordingly, this transfer criminal petition is allowed. C.C.No.444 of 2011 on the file of the XVI Special Magistrate, Hyderabad is withdrawn and is made over to the Court of the V Special Magistrate, Hyderabad for disposal according to law.
The miscellaneous petitions, if any, pending in this petition shall stand closed.
