Heard learned counsel for the petitioner; the learned Standing Counsel for the State-respondents 1 to 4; and perused the record.
The prayer in this petition is to command the respondents to ensure compliance of the order dated 15.03.2019 passed by the Civil Court in O.S. No. 179 of 2015.
From the document appended as Annexure No.2 to the petition, it appears that the petitioner instituted Suit No. 179 of 2015 in the Court of Civil Judge (Jr. Div.), Gautam Buddh Nagar which was decreed ex parte on 15.03.2019.
If any such decree is still operative, it is always open to the petitioner to put the decree for execution. Hence, the prayer made in this petition is misconceived.
The petition is dismissed without prejudice to the right of the petitioner to apply for execution of the decree, if the same is still operative.
