Heard learned counsel for the petitioner.
The only submission of the learned counsel for the petitioner is that to direct the respondent no.1 Civil Judge (Senior Division), IInd Mathura, District Mathura to decide the Misc. Case no. 53 of 2006 (Shree Mahesh Das and another vs. Shree Ravindra Pandey and others) for permanent injunction under Order 39 Rule 1 and 2.
In view of the aforesaid, it would serve no purpose to keep the writ petition pending, and therefore the writ petition is disposed of by directing the respondent no. 1 Civil Judge (Senior Judge), IInd Mathura, District Mathura to decide the Misc. Case no. 53 of 2006 (Shree Mahesh Das and another vs. Shree Ravindra Pandey and others) for permanent injunction under Order 39 Rule 1 and 2 expeditiously, preferably within a period of six months from the date of production of certified copy of this order in accordance with law.
It is clarified that this Court has not adjudicated upon the merits of the claim as raised by the petitioner in the present writ petition.
