Heard learned counsel for the petitioner and Sri Rajesh Srivastava, learned Standing Counsel for the State-respondent.
Petitioner is before this Court asking the District Panchayat Raj Officer, Jaunpur/third respondent to conclude the inquiry against the Gram Pradhan, namely, Nisha Devi (fifth respondent), Gram Panchayat Asmanpatti, Post Ramdayalganj, Block Sirkoni, District Jaunpur on complaint made by the petitioner dated 27.11.2018 in view of the provisions contained in Uttar Pradesh Panchayatraj (Removal of Pradhan, Up Pradhan and Members) Inquiry Rules, 1997.
In the facts and circumstances, no useful purpose would be served in keeping the writ petition and with the consent of the parties, the same stands disposed of finally with the direction that in case the aforesaid complaint is strictly in consonance with aforesaid Rules then the Authority concerned would definitely take cognizance and would proceed strictly in accordance with law, as expeditiously as possible but certainly after affording opportunity to the fifth respondent against whom the alleged allegations are being made.
