Heard learned counsel for the petitioner and Sri Saurabh Tiwari, learned counsel for the respondent No.4.
The petitioner by means of this writ petition wants a direction upon the respondent No.4 to remove encroachment from the public passage situate over Gata No.1440, Nagar Panchayat Purdilnagar, District Hathras.
The petitioner is not the owner of the aforesaid Gata and he has no rights over the same. The petitioner has not filed this petition in public interest or in a representative capacity.
Accordingly, we are of the opinion that since he has not personally aggrieved he has no locus to maintain this writ petition. It is dismissed.
