This petition is directed against the order dated 09.11.2011 vide which the alleged victim of rape namely Parul Singh has been lodged in Protection Home, because she refused to accompany her parents. The petition also challenges the order dated 18.10.2011, Annexure-2.
Learned counsel for the petitioner has drawn attention of the court towards Annexure-4 at page 20, i.e. statement of the prosecutrix, which is to the effect that she got married to the petitioner and had physical relations with him of her own freewill.
Considering the stand of the prosecutrix and assertion on the part of the petitioner that prosecutrix has attained the age of majority, issue notice to respondent no.2 through Chief Judicial Magistrate, Hardoi, for 06.6.2012.
Let the prosecutrix namely Parul Singh be produced from the Government Protection Home (Women), Prag Narain Road, Lucknow, on the next date of listing.
