On the basis of a will executed by the mother in his favour, the petitioner is claiming Bhumidhari right over the lands having Khasra No.272 area 0.051 hectare, Khasra No.273 area 0.400 hectare, Khasra No.278 area 0.031 hectare, Khasra No.382 area 0.051 hectare, Khasra No.399 area 0.290 hectare and Khasra No.410 area 0.594 hectare, total area 1.417 hectare. The petitioner after the death of his mother filed an application before the Tehsildar pursuant to an order passed by the Addl. District Magistrate, the competent authority under the Urban Land (Ceiling and Regulation) Act, 1976 to mutate the name of the petitioner in the revenue record. That application of the petitioner has not been considered nor the order of the Addl.District Magistrate has been complied with.
The writ petition is disposed of with the observation that the application of the petitioner be considered and decided in accordance with law by respondent no.3 as far as possible within a period of three months from the date of filing of a certified copy of this order before it.
