JUDGMENT / ORDER

Heard Dr. H.N. Tripathi, learned counsel for the petitioner.
It is contended that earlier the petitioner was terminated on 04.06.1994. The District Education Officer vide order dated 17.06.1994 disapproved the termination order of the petitioner. Thereafter, District Basic Education Officer has made an inspection and the petitioner was found in the institution. In his report he has recorded that in his presence, the Head Master of the institution did not permit the petitioner to sign the attendance register and misbehaved with him in front of the District Basic Education Officer.
It is contended that later a dismissal order allegedly to have been passed on 08.10.1996, which has been said to be approved by the District Basic Education Officer on 25.10.1996.
The petitioner has averred in the supplementary affidavit that the said order was passed without holding any enquiry and without furnishing opportunity to the petitioner.
On 05.07.2016 learned counsel for the B.S.A. was granted time to file counter affidavit to the supplementary affidavit but no counter affidavit has been filed.
In the interest of justice, a last opportunity is granted to the learned counsel for the B.S.A. to file counter affidavit to the supplementary affidavit within two weeks.
List this case again on 17.08.2016.
