Challenge in this petition to the F.I.R lodged at case crime no. 868 of 2009 under section 363/366/323/504/506 IPC P.S. Shahganj Dsitrict Agra.
The victim who is arrayed as petitioner no.3 namely Gudiya daughter of Kishan Singh Prajapati respondentno.3 is present in court. On being queried by the court, she stated that she was major and she had tied nuptial knots out of her own free will and without any coercion by any one.
Issue notice to respondent no.3 who may file counter affidavit within four weeks. Learned A.G.A may also file counter affidavit within the aforesaid period.Rejoinder affidavit if any may be filed within two weeks next thereafter. List this matter after expiry of the aforesaid period.
In the meanwhile, arrest of the petitioners namely Mahesh Chandra Parasar, SAtish Chandra Parasar, Guidya, Sonu Parasar, Smt. Vimla Devi, and Smt. Seema Devi who are wanted for offences as aforesaid shall remain stayed of course subject to the postulates that the petitioners shall extend full cooperation for smooth conduct of investigation and shall appear as and when called upon to do so.
