Pursuant to the earlier order of this Court counter affidavit has been filed on behalf of Smt. Vineeta Mishra, District Minority Welfare Officer, Allahabad which is taken on record. Another affidavit has also been filed by the same officer on behalf of opposite party no.4 informing the Court that he is ill and on leave, therefore, could not appear before the Court.
Sri Pankaj Saxena, learned standing counsel submits that against the order passed by the writ Court a special appeal has been filed which has been admitted and notice has been issued on the stay application.
List this case on 19th May, 2014. By that time in case counter affidavit is not filed by the opposite party no.4 he shall remain present before the Court on the date fixed. Learned standing counsel may also file a copy of interim order if any passed in special appeal on the stay application. Learned counsel for the applicant may also file rejoinder affidavit to the affidavit filed by the opposite party no.5 by the date fixed.
