(Per : HONOURABLE MR.JUSTICE AKIL KURESHI) When these petitions were taken up for hearing, learned counsel Shri Oza for the Department pointed out that in both the petitions, the petitioners have prayed for interest on draw-back benefits paid to the petitioners after some delay. He stated that such draw-back was paid pursuant to judgments passed by this Court. Such judgments have been challenged by the Department before the Apex Court. The leave has been granted and appeals are pending.
Under the circumstances, both the petitions are adjourned sine die. It would however be open for either side to request this Court for taking up the petitions for hearing, once the appeals are disposed of by the Supreme Court or for any other appropriate reason.
