This anticipatory bail application under Section 438 Cr.P.C. has been moved seeking the bail of applicant-Mahaveer Singh in the event of his arrest in Case Crime No.486 of 2018, under Section 376 I.P.C., Police Station Chhata, District-Mathura.
Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material available on record.
Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is further submitted that the opposite party no. 2 had taken money from the applicant and when he demanded, she levelled allegation of rape against the applicant. The applicant has not committed any such type of offence. He further submits that if the applicant is enlarged on anticipatory bail, he shall not misuse the liberty of bail and would co- operate with the investigation.
Learned AGA vehemently opposed the application and submitted that the allegation levelled against the applicant is grievous in nature.
Having regard to the submissions made by learned counsel for the parties, allegation made against the applicant, I do not find any good ground to release the applicant on anticipatory bail.
Accordingly, the anticipatory bail application is rejected.
However, if the applicant surrenders before the Court concerned in aforesaid case and file bail application, the same shall be heard and decided expeditiously in accordance with law.
