The petitioner has sought direction upon the Moradabad Development Authority to execute transfer instrument including freehold deed in respect of House No.D1-158, Ashiyana Phase- II (Double Storey), District Moradabad allotted to the petitioner vide registration no.103 of EWS/Ash./R02 dated 28.06.2002.
Shri K.M. Asthana, who appears for the Moradabad Development Authority, has obtained a letter dated 08.07.2021 from the Secretary, Moradabad Development Authority addressed to the District Magistrate in connection with complaint made by the petitioner in which it is stated that if the petitioner presents himself on any working day with the necessary stamps and registration fee, etc., the deed shall be executed. The letter also indicates that already approval has been granted in respect of execution of the deed.
Shri K.M. Asthana states that as and when the petitioner completes all the necessary formalities and requests the authority concerned to execute the transfer deed, the same shall be considered and addressed in accordance with law expeditiously and in terms of the letter dated 08.07.2021.
In view of the above, we deem it appropriate to dispose of this petition by leaving it open to the petitioner to approach the authority concerned of the Moradabad Development Authority for execution of the transfer deed in terms of the letter dated 08.07.2021.
Copy of the letter provided by Shri K.M. Asthana shall be retained as part of the record.
Shri K.M. Asthana has also provided a copy of the letter dated 08.07.2021 to the learned counsel for the petitioner.
