Heard learned counsel for the parties.
The petitioner has retired from the post of Mali on 28.02.2021 from the office of respondent no.4-Executive Engineer, IIIrd, Nirman Khand (Anubhag), Rural, U.P. Jal Nigam, Ghazipur.
The grievance of the petitioner is that his retiral dues, i.e., pension, gratuity, leave encashment and life insurance have not been paid by the respondents-authorities and petitioner in this respect has submitted an application on 16.09.2021 to the respondent no.4 but respondent no.4 has neither considered his application/ representation, nor has passed any order of payment of retiral dues and the petitioner is running from pillar to post.
Learned counsel for the respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.4 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case and without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with liberty to the petitioner to file a fresh representation before the respondent no.4-Executive Engineer, IIIrd, Nirman Khand (Anubhag), Rural, U.P. Jal Nigam, Ghazipur, along with a copy of this order downloaded from the official website of High Court, Allahabad, raising all his grievances within a period of two weeks from today. In case any such representation is filed by the petitioner, the respondent no.4 shall consider and decide the same, strictly in accordance with law, by a reasoned and speaking order, preferably within a period of two months thereafter.
The writ petition is disposed of subject to the observations made above.
