The learned counsel for the petitioner at the very outset submits that the matter travelled between the parties upto the Supreme Court. The Supreme Court vide order dasted 27.8.2018 passed the following order in SLP(Crl) No 5697 of 2018.
" Heard.
We are not inclined to interfere with the impugned order in exerciseof our jurisdiction under Article 136 of the Constitution of India.
However, we direct the Receiver to file accounts before the concerned court once in every six months. The first appellate court where the appeal is pending shall expedite the hearing of the appeal.
The Special leave petition is accordingly disposed of. Pending applications, if any, shall also stand disposed of."
The learned counsel submits that reference of the appeal mentioned in the Supreme Court order is the same for which this petition has been filed for expeditious disposal.
It is submitted that the order passed by Supreme Court has not been honoured in compliance till date.
At this stage, learned counsel further submits that probably, this order has not been placed before the trial court.
In view of the above, without going into further details of the case, it is directed that plaintiffs/petitioners herein shall filed a certified copy of the said order before the learned trial court within two weeks from today. After receipt of the said order, the trial court shall endeavour to honour the directions contained in the order of the Supreme Court in its letter and spirit.
The petition is disposed of in terms of the above directions.
