Heard Mr. A.K. Tripathi, learned counsel for the petitioner and Mr. Prateek Sinha, learned counsel for respondents-State.
The prayers made in the writ petition read thus:
(i) Issue a writ, order or direction in the nature of mandamus commanding the respondents to conduct C.B.I. enquiry in the matter of Victim Madhav case, District Mathura.
(ii) Issue a writ, order or direction in the nature of mandamus commanding the respondents to accord benefits of Section 357A Cr.P.C. i.e. Victim Compensation Scheme to the family members of victim Madhav.”
Insofar as the first prayer is concerned, we are not inclined to grant the same and we are informed that the investigation is in progress. That apart, no case for transferring the investigation to C.B.I. is made out by the petitioner. Insofar as the second prayer is concerned, we are informed that a compensation of Rs.5,00,000/- (five lacs) has already been extended to the family members of the victim and that same has been received by the father of the victim on 17.1.2018.
In the circumstances, we find no reason to keep this petition pending any further. The petition is, accordingly, disposed of.
