HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.35677 of 2014 ORDER:
Petitioner claims to be an Artist and student of JNTU College of Fine Arts, Hyderabad. He was awarded Gold Medal for academic and other achievements. He also did Master of Fine Arts (MFA) Jawaharlal Nehru Architecture and Fine Arts University, Hyderabad. He went to Germany on study tour sponsored by Indian Council for Cultural Relations (ICCR) Government of India. Petitioner claims to have conducted/organized Exhibitions, Art Camps and workshops. He also created Art works for German Pavilion at Expo 2000 at Hanover Germany, organized Tribal and Folk utility workshops at Nagpur and Art Camp at Terracota workshop, Hyderabad and so on.
2. After formation of State of Telangana, State of Telangana intended to represent in the Republic Day Celebrations on 26th January 2015 at New Delhi. In order to prepare cultural float, petitioner was selected by the State of Telangana. He was also deputed to participate in the deliberations with the Officers of Central Government in the meetings held on 29.09.2014 and 12.10.2014. As petitioner was in the process of preparing cultural float reflecting the cultural values of State of Telangana, to his surprise, he was informed that the representation of Telangana State for participation in Republic Day Celebrations was not agreed by the Central Government. Having come to know that Central Government has not accepted the State Government participation, even though Honourable Chief Minister addressed a letter personally to the Union Defence Minister requesting to consider the participation so far it was not favourably acted upon. In those circumstances, petitioner instituted this writ petition, alleging in action of respondents in not inviting petitioner for meeting held on 24.11.2014 to participate in Republic Day Celebrations and to present Telangana cultural Tableau at Republic Day celebrations to be held on 26.01.2015.
2. In this writ petition, petitioner is not espousing the cause of general public as with reference to participation of tableau of State of Telangana. His grievance is, the State having selected him to prepare cultural float of the State, he should have been allowed to participate in all deliberations by the Union Government and not inviting him to deliberations held on 24.11.2014 is illegal. Such participation is subject to Central Government allowing the State to represent in Republic Day Celebrations. Participation of State in Republic Day Celebrations is between the State Government and the Central Government. As an Art expert, he cannot have individual grievance to agitate whether Central Government should permit the State to be represented or not. Therefore, the relief sought in the writ petition cannot be granted. However, it is open to the petitioner to pursue with the State Government to take up the cause of representation of the State in the Republic Day Celebrations.
3. The Writ petition is accordingly dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
