Heard learned counsel for the petitioner, learned Standing Counsel for the respondent Nos. 1 and 2 and Sri Amit Shukla, learned counsel for the respondent No. 3.
The petitioner was appointed as Assistant Teacher in Primary School Raghopuri, District Pilibhit on 14.10.1981. Subsequently, the petitioner was appointed as Head Master in Uchchtar Prathmik Vidyalaya. The petitioner retired on 31.3.2017.
Grievance of the petitioner is that he has not been given selection grade during the service period for which he was entitled and as such, his pension has been fixed in lower grade.
Learned counsel for the petitioner submits that the petitioner has submitted representations in this regard to the respondent No. 3 on 10.7.2019 and 18.9.2019, copy of which are annexed as Annexure No. 4 & 5 to the writ petition but the respondent No. 3 has not considered the said representations of the petitioner.
Sri Amit Shukla, learned counsel for the respondent No. 3 submits that the respondent No. 3 may be directed to consider the grievance of the petitioner.
Considering the facts and circumstances of the case and in view of the statement made by Sri Amit Shukla, learned counsel for the respondent No. 3, the present writ petition is disposed of with direction to the respondent No. 3 to consider and decide the representation of the petitioner, annexure No. 5 to the writ petition within a period of three months from the date of production of a certified copy of this order.
