JUDGMENT / ORDER

The petitioner is the registered owner of the vehicle bearing No.KL.8S.1239, which got involved in a road traffic accident on 24.08.2001, leading to Ext.P1 award passed by the MACT, Thrissur awarding compensation of Rs.36,500/- with interest from 22.05.2002 with cost. The vehicle in fact was driven by the 5th respondent. The 4th respondent is the claimant and the third respondent is the insurer. By virtue of violation of statutory prescriptions and conditions of policy, the Tribunal permitted the Insurer to recover the amount after satisfaction of the due amount to the claimant. It is in the course of such proceedings that the petitioner has been required to satisfy the amount by setting the machinery under the Revenue Recovery Act.
2. The learned Counsel for the petitioner submits that the petitioner does not intend to dispute the liability and that the only prayer is to grant some breathing time to clear the liability by way of reasonable installments.
3. Heard the learned Government Pleader as well.

In the above circumstance, the writ petition is disposed of , permitting the petitioner to satisfy the entire liability by way of 'six' equal monthly installments, the first of which shall be effected on or before 31.12.2014, followed by similar installments to be effected on or before the last working day of the succeeding months. Subject to the above, the recovery proceedings now stated as being pursued against the petitioner and his property will be kept in abeyance. It is made clear that, if any default is committed by the petitioner in remitting any of the installments, the respondents will be at liberty to proceed with coercive steps from the stage where it stands now, for realisation of the amount in a lump.
