This contempt case was filed alleging willful disobedience to the order dated 3.10.2013 passed by this Court in W.P.M.P. No. 30189 of 2013 in Writ Petition No. 24532 of 2013.
By the said order, this Court directed the respondents to permit the petitioners to fell and transport Eucalyptus trees from their lands in accordance with the due procedure, if any, without applying the A.P. Preservation of Private Forest Rules, 1978 to them.
The cause for complaint in this case was that the Deputy Range Officer, Paderu, at the instance of the Divisional Forest Officer, Paderu Division, seized the lorry bearing No. AP 24 TB 636 on 17.11.2013 on the ground that the felled Eucalyptus trees were being transported by the petitioner.
It is now stated by Sri M. Solomon Raju, learned counsel for the petitioner, that the said seizure has been lifted and the lorry in question has been released.
In that view of the matter, the cause for contempt in this contempt case does not survive and the contempt case is closed. Needless to state, if there is any violation of the order passed by this Court in future, it would always be open to the petitioner to approach this Court by way of fresh contempt proceedings. No order as to costs.
