The petitioner in this writ petition is seeking a direction to the respondent no.1 to consider and decide the Revision No. nil dated 18.3.2019 expeditiously. It is also prayed that the interim stay application filed in the said Revision may also be decided expeditiously within a fixed period of time.
We find that in an earlier writ petition, filed by the petitioner, being Writ C No. 12910 of 2017 decided on 16.5.2017, learned counsel appearing for the respondent no.3 has made a statement that till the revision of the petitioner is considered and decided on merits, the respondent no.3 shall not make any further construction on the basis of the revised layout plan. We, therefore, direct that no construction shall be made by the respondent no.3 till the Revision dated 18.3.2019 filed by the petitioner is decided and the respondent no.3 shall abide by the undertaking given by his counsel before the Court in the aforesaid writ petition No useful purpose would be served by keeping the matter pending.
We, therefore, dispose of the writ petition with the direction to the respondent no.1 to consider and decide the petitioner's interim stay application filed in the Revision No. nil dated 18.3.2019 within a period of 15 days from the date of receipt of a certified copy of this order and in any case the revision shall be decided within a period of three months thereafter.
