1.0. Present Civil Application has been preferred by the applicant-original appellant-original plaintiff for interim relief in following terms.
"Pending hearing and final disposal of this Second Appeal, Your Lordships be pleased to stay the judgment and order dated 18.3.2008 passed by the Additional District Judge and Presiding Officer, 3rd Fast Track Court, Nadiad in Regular Civil Appeal No.113 of 1998 and the judgment and order dated 12.8.1998 passed by the 8th Joint Civil Judge (S.D) Nadiad in Regular Civil Suit No.308 of 1989 and restrain the opponents-original defendants from interfering with the possession of Land being Survey No.1028/1 and 1028/2 situated at Nadiad."
2.0. Heard Shri D.G. Chauhan, learned advocate for the applicant and Shri M.B. Gandhi, learned advocate with Shri Vyas, learned advocate for the respondent no.2 on interim relief. It is to be noted that by ad-interim relief dated 13.2.2009 the respondents were restrained from peaceful enjoyment and vacant possession of the appellants of the property till further orders and the said ad-interim relief has been continued till date. It appears that even some further interim order was passed in the application preferred by the respondent no.2 herein. Under the circumstances, ad-interim relief granted earlier is directed to be continued as interim relief till final disposal of the main second appeal. Rule is made absolute to the aforesaid extent.
