(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application is a successive bail application and earlier similar application was made, which came to be rejected by this Court on 15.10.2010 in Criminal Misc. Application No.9859 of 2010.
Under these circumstances, the present application cannot be granted for regular bail. However, it further appears that the main matter is fixed for final hearing on 9.2.2012. Therefore, the second ground of not hearing the appeal within some time would no more survive. Hence, the application is disposed of accordingly with the direction that the main appeal shall be listed for final hearing on 9.2.2012.
