ORDER:
This writ petition is filed for a mandamus to declare the action of the official respondents in not considering the petitioner’s representation, dated 14.10.2014, made against respondent No.5 and in not preventing the said respondent from laying a road over the bund of fresh water tank existing at Seri Golvepalli Village, Gudiwada Rural Mandal, Krishna District as illegal and arbitrary.
I have heard Sri G.Vasantha Rayudu, learned counsel for the petitioner, the learned Assistant Government Pleader for Panchayat Raj appearing for respondent Nos.2 and 3, and perused the record.
The petitioner claims to be a ward member of Seri Golvepalli Grampanchayath. He has alleged that in the absence of any resolution passed by the Seri Golvepalli Grampanchayt, respondent No.5 has taken upon himself to lay a road over the fresh water tank bund by causing damage to the tank and to the detriment of the ayacutdars of the water tank and that though a detailed representation is made by him on 14.10.2014, none of respondent Nos.2 to 4 has taken any action.
Since respondent No.2 is stated to be the competent authority to examine the petitioner’s grievance, the said respondent is directed to consider the same after notice to the petitioner and respondent No.5, take an appropriate decision and communicate the same to both the parties within one month from the date of receipt of a copy of this order.
Subject to the above directions, the writ petition is disposed of.
As a sequel to disposal of the writ petition, W.P.M.P.No.39828 of 2014 shall stand disposed of as infructuous.
