JUDGMENT / ORDER

Mr H.A Dave learned advocate for the applicant and Mr Shakeel A Qureshi learned advocate for respondent No. 2, submit that the matter is settled between the parties and in support thereof my attention is drawn to the affidavit of the respondent No. 2 (original complainant) Annexure B.
The perusal of the FIR reveals that the respondent No. 2 lodged the FIR against the petitioner and other persons for the offences punishable under section 406,420, 467, 468, 471, 114 of Indian Penal Code. It is submitted by learned counsel for the parties and on the perusal of the affidavit at Annexure B, it seems that the matter is settled by the respondent No. 2 qua the petitioner. It further transpires that the dispute involved qua the petitioner was personnel and private in nature.
In the above view of the matter now nothing more is required to be done in connection with the FIR qua the petitioner and the petition deserves to be allowed as under.
The petition is allowed and the FIR filed before Nadiad Paschim (West)Police Station bearing C.R No. I 27 of 2011 along with all the subsequent proceedings thereto qua the petitioner stands quashed. Direct service is permitted.
