(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail on the ground that he wants to make arrangement for repayment of debts, if required, even by selling the property since the amount he is owing, is to the father in law of his daughter.
Pursuant to the earlier order passed by this Court, learned APP, Shri Pandya, based on the report which he has received from Vichchhiya Police Station has submitted that statement of Kantibhai Limbabhai, who is father-in-law of the daughter of the present applicant is recorded, and from the said statement it transpires that the money demanded by the said person, is that which he had landed to the applicant.
From the jail remarks, it appears that whenever the applicant-convict was enlarged on bail, he has surrendered to the jail authority in time.
Considering the totality of the facts, it is directed that the applicant shall be enlarged on temporary bail for a period of one week from the date of his actual release on personal bond of Rs.5,000/- with one surety of the like amount and with the further direction that he shall surrender with the jail authority on expiry of the period granted by this Court.
Application is allowed accordingly. Rule made absolute.
