This is a petition under Section 227 of the Constitution of India by which the petitioners prayed for early disposal of J.S.C.C. Suit No. 99 of 2016.
The petitioners are owner of the property/house in question in which on the ground floor the respondent is residing as a tenant.
The property in question is situates at Harjinder Nagar, Lal Bangla, Main Road, Kanpur Nagar. According to the petitioners, the respondent, who is a 'patrakaar' is not participated in the proceedings since more than one and half year, as such is avoiding the proceedings. According to the petitioners, accommodation of one hall, two rooms, toilet etc. is in possession of the respondent/tenant.
Having heard learned counsel for the petitioners, the petition is disposed of by directing the court below to decide J.S.C.C. Suit No. 99 of 2016 as well as the application dated 21.05.2018 filed under Order 8 Rule 10 C.P.C. expeditiously within a period of six months.
The petition is accordingly disposed of.
