Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying to issue a WRIT OF HABEAS CORPUS, directing the respondents to produce all the detenus, namely, 1) Rasik Ali, son of Aziz Ali, aged 50 years, 2) Bahar Hussain, son of Farzan Ali, aged 45 years, 3) Sabir, son of Aziz Ali, aged 35 years, 4) Imtiaz Ali, son of Tillu, aged 32 years, 5) Khan, son of Rahulal, aged 48 years, 6) Abbaz, son of Sakkur, aged 22 years, 7) Abbaz, son of Riyaz, aged 25 years and 8) Riaz,6 son of Sarhan, aged 22 years, who are in the illegal custody of the respondents and to set them at liberty.
For Petitioner : Ms.J.Varnashree For Respondents : Mr.V.M.R.Rajentran, APP ORDER [Order of the Court was made by M.JAICHANDREN, J. ] Heard the learned counsel appearing on behalf of the petitioner, as well as the learned Additional Public Prosecutor appearing on behalf of the respondents.
2 This Habeas Corpus Petition has been filed by the petitioner, seeking direction to the respondents to produce the detenus, namely, 1) Rasik Ali, son of Aziz Ali, aged 50 years, 2) Bahar Hussain, son of Farzan Ali, aged 45 years, 3) Sabir, son of Aziz Ali, aged 35 years, 4) Imtiaz Ali, son of Tillu, aged 32 years, 5) Khan, son of Rahulal, aged 48 years, 6) Abbaz, son of Sakkur, aged 22 years, 7) Abbaz, son of Riyaz, aged 25 years and 8) Riaz, son of Sarhan, aged 22 years, who are in the illegal custody of the respondents and to set them at liberty.
3 At this stage of the hearing of the Habeas Corpus Petition, the learned Additional Public Prosecutor had submitted that all the detenus had been arrested, on 16.2.2017, in respect of Crime No.175 of 2017, on the file of Dharmapuri Town Police Station and remanded in custody, by the learned Judicial Magistrate-I, Dharmapuri. He had further submitted that the detenus had been lodged in the Central Prison, Salem, at present.
4 In such circumstances, this Court is of the considered view that no further orders are necessary in the present Habeas Corpus Petition. Hence, the Habeas Corpus Petition stands dismissed.
