Heard learned counsel for the petitioner and Shri Deepak Kumar Singh, learned State Law Officer.
The petitioner (complainant) is before this Court for a direction to the Sub Divisional Magistrate concerned to take necessary action on the representation/ complaint dated 1.1.2019 against the alleged resolution for allotment of license of Fair price shop passed in favour of son of the Pradhan of the village in question (fourth respondent).
It is contended that entire resolution is in teeth of Government Orders dated 3.7.1990 and 18.7.2002 and as such it is requested that before finalising the proceeding for approval by the competent authority qua the license of the fair price shop in question, the representation/ complaint dated 1.1.2019 may be decided.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of asking the Sub Divisional Magistrate concerned to take a final call in the matter strictly in accordance with the aforesaid Government Orders but certainly after giving opportunity to all the stake holders in the matter specially fourth respondent in whose favour the alleged resolution has been passed.
