Madireddy Pansa Reddy … Petitioner and The District Collector, Ranga Reddy District and others … Respondents THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.15760 OF 2004 O R D E R This writ petition was filed aggrieved by the alleged inaction of the revenue authorities in initiating proceedings for restoring the assigned land admeasuring Ac.2.00 cents in Sy.No.473/2, Nagaram Village, Keesara Mandal, Ranga Reddy District, to the petitioner. The case of the petitioner was that the subject land was assigned to his father and was sold by him to the third respondent herein under a registered deed of conveyance. As the said sale was in contravention of the provisions of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977 (for brevity, ‘the Act of 1977’), the petitioner approached the revenue authorities seeking restoration of the assigned land in terms of the Act of 1977. Alleging that the authorities failed to take necessary action, he filed the present writ petition.
It appears that the Tahsildar, Keesara Mandal, Ranga Reddy District, under proceedings dated 27-06-2011, resumed the subject land from the third respondent on the ground that the sale in his favour was in violation of the provisions of the Act of 1977.
Sri M.S.N. Prasad, learned counsel for the third respondent, would however submit that the said order has not attained finality and the appeal filed by his client thereagainst is pending consideration. He further states that an order of status quo has been passed by this Court and the same is to be maintained during the pendency of the said appeal.
Sri P. Roy Reddy, learned counsel for the petitioner, would contend that mere resumption of the assigned land under the proceedings dated 27-06-2011 would not put an end to his client’s grievance as his prayer is for restoration of the assigned land.
Given the aforestated circumstances, this Court is of the opinion that the present writ petition, as framed, cannot be adjudicated in the light of the subsequent developments. As the resumption proceedings dated 27-06-2011 are yet to attain finality, the stage has not come for the petitioner to seek restoration of the assigned land.
The writ petition is accordingly closed leaving it open to the petitioner to work out his remedies in accordance with law. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
