Heard learned counsel for the petitioner and the learned standing counsel for the State-respondents.
This writ petition has been filed for a direction to respondent no.2 to decide Recall Application dated 8.6.2018 in Appeal No.205/T-20/41506062105 (Satya Narayan v. Smt. Madhuri) pending in the court of Sub Divisional Magistrate, Budhanpur, district Azamgarh, within a time bound period.
Learned standing counsel has no objection to the aforesaid request of the learned counsel for the petitioner.
Considering the facts and circumstances of the case, no useful purpose will be served to keep this petition pending and call for a counter affidavit.
In view of the aforesaid, this petition is disposed of providing that the authority concerned shall decide the aforesaid case in accordance with law, expeditiously, preferably within four months from the date of presentation of a certified copy of this order and without granting any unnecessary adjournment to either of the parties, if there is no legal impediment.
