Learned Standing Counsel has pointed out that a First Information Report had already been lodged against the petitioner no.2 as Case Crime No.0154 of 2021, under Section 363 I.P.C., Police Station-Holagarh, District-Allahabad.
The petitioner had earlier approached this Court through Criminal Misc. Writ Petition No.4612 of 2021, wherein this Court had granted interim protection till the submission of police report under Section 173(2) Cr.P.C.
Present writ petition is not maintainable as the First Information Report had already been lodged and the petitioner had challenged the same before this Court in which this Court had already taken cognizance on 28.06.2021.
In view of the above, writ petition is dismissed as not maintainable.
