Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court may be pleased to issue a writ, order or direction more so one in the nature of mandamus declaring Rule – 10(5)(i) & (ii) and Sl.No. 17 of Schedule III of Rule-10 of the A.P. Minor Mineral Concession Rules, 1966 as amended by G.O.Ms.No. 104, Industries & Commerce Department dt. 15-05-2005 as illegal, arbitrary, violative of the provisions of the Mines and Minerals (Development & Regulation) Act, 1957 and the Rules made there under apart from being violative of Article 14 of the Constitution of India.
The petition coming on for hearing, upon perusing the petition and the affidavit filed herein and the order of the High Court dated 26-07-2010 made in WPMP.No. 21712/2010 and upon hearing the arguments of Sri Pannala Srinivas, Advocate for the Petitioner, the Court made the following ORDER:
“ Not only have the respondents filed any counter affidavit there is also no appearance on behalf of the respondents.
The writ petition is already admitted.
List on 12-09-2012.
Interim orders to continue until then.”
