The petitioner, an Assistant Teacher in English in the State run institutions, has filed the instant petition for issuance of a mandamus commanding respondent no.3, Additional Director of Secondary Education to take appropriate decision in pursuance of the recommendation made by District Inspector of Schools on 19.9.2018. The District Inspector of Schools has recommended for cancellation of the transfer order of the petitioner to Rajkiya Uchchatar Madhyamik Vidyalaya, Tilshahari and for her posting at Rajkiya Balika Vidyalaya, Ghatampur, Kanpur Nagar where, according to District Inspector of Schools, there is no teacher in English subject.
Learned standing counsel very fairly states that the third respondent will examine the issue and will take appropriate decision within such time as may be directed by this Court.
Learned counsel for the petitioner submitted that the petitioner has already represented to respondent no.3 by submitting a representation dated 16.1.2019 and it may be directed to be decided within a specified time.
Accordingly, the instant petition is disposed of by directing the third respondent to decide the representation of the petitioner dated 16.1.2019 (Annexure 10) by means of a speaking order within a period of eight weeks from the date of production of certified copy of this order alongwith photostat copy of representation dated 16.1.2019 as well as copy of recommendation dated 19.9.2018 by the District Inspector of Schools.
