Petitioner claims that he is the holder of permit to construct a residential building under Indira Awaas Yogana Scheme as evident from Ext.P1. Petitioner approached the Village Officer for removing soil from the site covered by Ext.P1. 2. Learned counsel for the petitioner submits that in view of the Government order, petitioner does not require permission from any authority for extracting soil or ordinary earth from the site covered by Ext.P1.
3. However, for the purpose of transporting ordinary earth, P-form from the Geologist is necessary. Therefore, petitioner shall approach the Geologist with an application for issuing necessary P-form based on Ext.P1. There shall be a direction to the Geologist to issue necessary P- form without insisting for NOC or environmental clearance within ten days from moving of such application. It is made clear that in the circumstances as above, the application submitted by the petitioner before the Village Officer is redundant and petitioner does not require such permission.
The Writ Petition is disposed of as above.
